Terms and Conditions

All rights, titles and interest in any and all copyright rights that emanate from any work performed in connection with the Project shall, upon creation, become the sole and absolute property of Artist.Where applicable, the Foundry will receive recognition as the casting Foundry in advertising that includes the Artist’s name.

The Foundry shall have the right to advertise their relationship with the project as  long as credits are given to the Artist.

The Foundry warrantees and guarantees all bronze castings to be (a) free  from faults of material and workmanship for a period of one (1) year after  installation (warranty period) (b) free and clear of any liens and claims from  any source whatsoever.  This guarantee shall apply to that work which is entirely  that of the Foundry (or persons responsible to the Foundry).  The Foundry will  promptly repair or replace all defects due to faulty material or workmanship  which arise during the warranty period, at its sole cost and expense.
 
The Foundry further warrants that the metal used in the sculptures to be industrial standard silicon bronze, commonly known as “Everdur.”  Castings will be free of excessive surface cracks, shell inclusions, and porosity per accepted industry standards. Panels will be a normal 3/16” thick except in areas where surface area or structural requirements may require a variance.  All materials and craftsmanship used in the initial work or any subsequent repairs shall be in accordance with acceptable industry standards.  All structural engineering related to the castings and its associated armature will be the responsibility of the Foundry.  The Foundry will correct at its sole cost and expense any associated defects at no cost to the Artist.
